Welcome to Tension. These Terms of Service ("Terms") govern your access to and use of the services provided by TKB Studio LLC ("we," "us," or "our"), including the Tension website, applications, and all related features (collectively, the "Service"). The primary purpose of the Service is interactive AI storytelling and character-based entertainment.
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age. If we discover that a user is under 18, we will immediately terminate their account. Misrepresenting your age constitutes a material breach of these Terms.
You may need to create an account to access certain features. You agree to provide accurate and complete information during registration and to keep your information up to date.
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
You may not transfer your account to another person, create multiple accounts for abusive purposes, or share your account credentials with others.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms. You may not:
"User Content" means any content you create, upload, or submit through the Service, including characters, stories, profile information, chat messages, images, and other materials.
You retain ownership of the User Content you create. However, by submitting User Content to the Service, you grant TKB Studio LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your User Content solely for the purpose of operating, improving, and promoting the Service.
You are solely responsible for the User Content you create or share. You represent that you have all necessary rights to the content you submit and that it does not infringe any third-party rights.
Content you publish publicly on the Service (such as shared characters or stories) may be viewed, used, and interacted with by other users. You acknowledge that public content may be accessed by anyone using the Service.
You agree not to create, upload, or share content that:

The Service may allow access to mature or adult content ("NSFW Content") for users who are 18 years of age or older. The following rules apply:
The Service uses third-party artificial intelligence models to generate content. You understand and agree that:
The Service, including its design, features, code, logos, and trademarks, is owned by TKB Studio LLC and protected by intellectual property laws. You may not use our trademarks or branding without prior written permission.
If you believe that content on the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:

The Service may offer virtual currency ("Daisies") or other purchasable items. All purchases are final and non-refundable except as required by applicable law.
Payments are processed by third-party payment providers. By making a purchase, you agree to the payment provider's terms. We do not store your payment credentials.
We reserve the right to change pricing at any time. Price changes will not affect purchases already completed.
Unused Daisies may be refunded within 48 hours of purchase. Once your Daisy balance decreases after a purchase, that purchase is no longer eligible for a refund. Duplicate or erroneous charges will be fully refunded. Virtual currency has no real-world monetary value and cannot be exchanged for cash. For full details, please see our Refund Policy.
The Service offers a Creator Revenue Program that allows eligible creators to earn revenue when other users interact with their published content. Participation in this program is subject to these Terms and any additional guidelines we may publish.
Revenue is generated only from "Paid Works" — content that meets certain feature requirements. Content classified as "Free Works" does not generate revenue. The classification is as follows:
Creators earn $0.003 USD per qualifying message sent by other users to their Paid Works. We reserve the right to change the revenue rate at any time with prior notice. Changes may apply retroactively to accrued but unwithdrawn revenue; however, we will provide a 30-day withdrawal window following any rate change notification, during which creators may withdraw their accrued revenue at the previous rate.
We reserve the right to cancel, withhold, or reclaim revenue in the following circumstances:
If we discontinue the Creator Revenue Program or the Service, we will provide at least 30 days' prior notice via email to affected creators and open a final withdrawal period. Revenue not withdrawn during this period will be forfeited.
Creators are solely responsible for reporting and paying any taxes applicable to revenue earned through the Creator Revenue Program. We may require tax-related documentation (such as IRS Form W-9 or W-8BEN) before processing withdrawals.
You may terminate your account at any time through the account settings or by contacting us. Upon termination, your right to use the Service ceases immediately.
We may suspend or terminate your account at any time, with or without cause or notice, including for violations of these Terms. We are not liable for any loss resulting from account suspension or termination.
Upon termination, your license to use the Service is revoked. We may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Sections 4.2, 7, 10, 12, 13, 14, 15, 16, and 17) will continue in effect.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TKB STUDIO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total liability for any claim arising from or related to the Service shall not exceed the greater of: (a) the amount you have paid to us in the 12 months preceding the claim, or (b) $50 USD.
You agree to indemnify, defend, and hold harmless TKB Studio LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
Before initiating any formal dispute resolution, you agree to first contact us at TKBSTUDIOLLC@gmail.com and attempt to resolve the dispute informally for at least 30 days.
If the dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English and the arbitrator's decision will be final and binding.
YOU AND TKB STUDIO LLC AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. NEITHER PARTY SHALL PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION OR ARBITRATION.
YOU AND TKB STUDIO LLC WAIVE THE RIGHT TO A JURY TRIAL FOR ANY DISPUTES.
Either party may bring a claim in small claims court if eligible. Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property infringement or unauthorized access to the Service.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms with a new "Last Updated" date. For significant changes, we may provide additional notice (such as an in-app notification). Your continued use of the Service after changes constitutes acceptance.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TKB Studio LLC regarding the Service.
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision.
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights at any time without notice.
